Officers report:
On December 31, 2023, I was on duty, in my full NMSP uniform displaying my badge of office. I had earlier attended a DWI checkpoint briefing held by New Mexico State Police (NMSP) Sergeant N. Searle. The checkpoint was located in the westbound lanes of Paseo Del Norte at Kimmick. This is in the city of Albuquerque, County of Bernalillo, State of New Mexico. At approximately 0037 hours on January 1, 2024, I observed a blue-colored Chevy pickup enter the #1 lane and pull up to where I was standing.
I contacted the driver through the driver-side window. I identified myself and the reason for the checkpoint. The female driver stared straight ahead and did not make eye contact with me. I later identified the driver as Adrienne Seay by her New Mexico driver’s license through the NMSP dispatch. I could smell the heavy odor of alcoholic beverage emitting from the vehicle. I asked her if she had consumed alcohol. She indicated she had consumed alcohol. I asked her to exit the vehicle and walk with me to the secondary testing location. I observed Ms. Seay have a hard time putting the vehicle in park, opening the door, and stepping out. While it was already in park Ms. Seay attempted to place it in park again, while reaching for the door handle to open the door Ms. Seay had a hard time locating it with her hand and it took her three attempts to open it, while stepping out of her vehicle Ms. Seay used her door and frame for balance.
I asked Ms. Seay to speak with me in front of my unit. While walking from Ms. Seay's vehicle to the front of my police vehicle, Ms. Seay walked slowly and had to be told more than once the direction I needed her to go. Ms. Seay stated she had consumed a couple of glasses of wine before driving. While speaking with Ms. Seay in front of my unit, I observed her eyes were bloodshot and watery. Now outside of the vehicle, I could still smell the odor of an alcoholic beverage emitting from her breath and on her person. I observed her words were slurred as she spoke. Ms. Seay stated she was a Bernalillo County Sheriff's Deputy.
At this point, I conducted Standardized Field Sobriety Tests to determine if she was able to safely operate a motor vehicle.
I asked Ms. Seay if she had any head injuries or any injuries that would prevent her from walking and turning and standing on one leg, and she stated “No”. Ms. Seay had a hard time listening to simple instructions. I had to ask Ms. Seay to face me more than once to begin the Standard Field Sobriety Tests (SFSTs). While being placed in the instruction stance Ms. Seay placed her left foot in front of her right foot after being explained and shown to place her right foot in front of her left. I know that Ms. Seay has had extensive training on how to conduct SFST’s while becoming a commissioned Deputy for BCSO. Her inability to correctly get into the instructional stance was a concern. Upon completion of all SFSTs and based on my training, experience, and the totality of the circumstances, I observed Ms. Seay display signs of impairment and determined Ms. Seay was unable to continue to operate a motor vehicle safely. Ms. Seay was read the NM implied Consent verbatim from the card issued to me. She refused to provide a chemical test. I visually checked the interior of her mouth to ensure it was free and clear of any foreign matter which it was. Ms. Seay was placed in the right rear seat of my patrol unit, where I seat-belted her.
I transported Ms. Seay to the Albuquerque State Police office where I placed her in front of a properly functioning IR-8000 breathalyzer instrument. After a 20-minute deprivation period, I gave her another opportunity to provide a chemical test. Once the machine was ready, I provided her with instructions on how to take the test. She again refused to provide a valid breath sample, stating “No”.
On completion of my paperwork, Ms. Seay was taken to the Metropolitan Detention Center (MDC)
Ms. Seay was given all the paperwork pertaining to her arrest.
This concludes my involvement in this incident.
